TERMS AND CONDITIONS OF CONTRACTOR / SELF-EMPLOYED WORK BETWEEN

(1)        York Maze Ltd of Elvington Lane, York, YO19 5LT (hereinafter referred to as “we”, “us” or “the Company”)

And

(hereinafter referred to as “you” or “the Contractor”)

IT IS HEREBY AGREED as follows: -

1. Appointment
1.1. York Maze Ltd shall from a date not before 6th October 2025 engage the services of the Contractor as a Scare Actor/Performer at York Maze Ltd (the Company) to carry out upon the premises the profession of scare acting /performing as per the terms and conditions set out below.
1.2. This is not an employment contract and does not confer any employment rights on you. In particular it does not create any obligation on the company to provide work to you.

2. Whereas
2.1 The Company has a need for Acting / Performing services; and
2.2 The Contractor has an interest in performing such services for the company; and
2.3 The parties wish to set forth the terms and conditions upon which such services will be provided to the Company.

3. Duties & Responsibilities
3.1 You are engaged as a Scare Actor / Performer. Your day-to-day activities will be overseen and managed by Scream Park Entertainments who are contracted by the Company to engage, train and manage the actors / performers on behalf of the Company. On joining, you will be assigned to a team and your acting responsibilities will be given to you by your team leader or Performance Manager. However, you are expected to undertake other duties reasonably assigned to you by the Company, irrespective of your job title or status.
3.2 You will be required to undertake the duties and responsibilities of a Scare Actor / Performer as advised to you by Screampark Entertainments in conjunction with the Scream Training booklet.
3.3 In order to fulfil the role of Scare Actor / Performer, it is a requirement that you have attended the Scream Park Entertainments training course or a Scream Training recap session in the past 3 months.
3.4 You are also required to attend a rehearsal prior to the event opening as part of your training in preparation for this role.
3.5 The Company reserves the right to vary these duties and responsibilities at any time and from time to time according to the needs of the Company’s business.

4. Date of Commencement / Project Schedule
You are engaged for the specific project of Hallowscream & Hallowtween 2025
(“the Project”).
4.1 Actual rehearsal & performance dates are as advised to you by Screampark Entertainments.
4.2 In accepting this engagement, it shall be deemed that you have accepted all the terms and conditions set out in this agreement.
4.3 This agreement annuls/supersedes any previous agreement whether verbal or written, given to you at any time.

5. Hours of Work / Availability of Work
5.1 Working hours for Hallowscream will be between 5.30pm and 11:30pm. Hallowtween from 11:30am – 5:30pm. However there may be requirement to work earlier or later than the specified times, in order to resource the event effectively.
5.2 Working hours will be confirmed to you and managed through Scream Park Entertainments.
5.3 All shifts include 2 x 30 minute breaks.
5.4 Daily signed timesheets supplied by your Scream Park Entertainments Team Leader and/or Performance Manager will be used as confirmation of hours worked and for the purpose of approving invoices.
5.5 You will be required to be on site one hour before the event start time, for the purpose of makeup application & costume dressing.
5.6 It is a condition of your engagement that you work flexibly in accordance with the working arrangements operated by the Company.
5.7 You acknowledge that although the Company will use its best endeavours to allocate you suitable work when it is available, the Company is under no obligation to provide you with any work or to provide any minimum number of hours of work in any day or week. Please note it is possible that the request made to you to work, is withdrawn within 24 hours of that work.
5.8 Once you have informed the company of your availability for event dates, you are obliged to accept those hours of work offered. The company has no obligation to offer you work on an ongoing basis.
5.9 When at work, you will devote the whole of your time attention and abilities to the work we allocate to you from time to time.

6. Place of Work
6.1 The Project will take place at the Company’s premises at the York Maze, Elvington Lane, York YO19 5LT.

7. Contract Fees & Invoicing
7.1 The agreed fees for Hallowscream & Hallowtween are £55.00 per rehearsal afternoon/night and £75.00 per performance afternoon/night.
7.2 As a Contractor, whether you are operating through a company or self-employed, you must submit a proper invoice for the work done. Your invoice should include your business name and address (if invoicing as a business) or if you are invoicing as self- employed your legal name & residential address. You should also include a contact phone number and email address. All invoices must include an invoice date, a unique invoice number, a detailed breakdown of the services you have provided and the fees you are charging. Payments will be made by BACS so your invoice must show your bank account details including the exact name your account is in, the name of the bank, sort code and account number. If you are invoicing as self-employed where practicable your invoice should also include your Unique Taxpayer Reference (UTR).
7.3 Your invoice should be submitted once the contract has been completed and ideally within one week of the contract ending. Invoices properly submitted within this window will be paid by BACS within 14 days, though we aim to pay within 7 days. Late invoices or invoices with queries may not be paid within this timeframe.

8 Sickness Reporting and Pay
8.1 If you are unavailable for work due to sickness, it is your responsibility to notify ScreamPark at your earliest convenience and no later than one hour prior to the start of your shift. You should report any sickness absence by telephone to your Scream Park Entertainments Team Leader or Performance Manager. You will need to update ScreamPark on a daily basis in regard to your sickness absence and expected return date.
8.2 If you are taken ill during a shift, the amount we will pay you will be at the discretion of the Performance Manager but is recommended to be 50% of your shift if you finish before 9pm and full pay for a later departure.

9. TAX
9.1. Nothing herein contained shall be construed or have the effect of constituting the relationship of partners or employer and employee between the parties. The Contractor shall at all times be responsible for the payment of their own National Insurance Contributions and for payment of their own Income/Corporation Tax and VAT.
9.2. The Contractor agrees to indemnify the Company in respect of any claims that may be made by the relevant authorities against the Company in respect of any income tax or national insurance contributions or similar taxes or contributions, including interest and penalties, relating to the Acting / Performing Services carried out by him/her under this Agreement.

10. Confidentiality
All information that:
● is or has been acquired by you during, or in the course of your work, or has otherwise been acquired by you in confidence
● relates particularly to our business, or that of other persons or bodies with whom we have dealings of any sort and
● has not been made public by, or with our authority

shall be confidential, and (save in the course of our business or as required by law) you shall not at any time, whether before or after the termination of your contract, disclose such information to any person without our prior written consent.

You shall make yourself aware of the Company’s policies in relation to compliance with data protection legislation that is in force from time to time and undertake to act in accordance with these at all times, including exercising reasonable care to keep safe all documentary or other material containing confidential information. You shall inform the Company immediately upon discovery of a data breach. You shall, at the time of termination of your contract with us, or at any other time upon demand, return to us any such material in your possession.

11. DBS Condition
11.1 It is a condition of this agreement that engagement may be subject to the receipt of a relevant Disclosure Certificate (determined by the Company) from the DBS (or other relevant authority), which does not disclose any matter not voluntarily disclosed to the Company before or at interview or prior or during the Contractor’s engagement, and
11.1.1 In the event of the Disclosure Certificate revealing any such matter, the Contractor shall be liable to a review of the disclosure in light of the company’s business and customers;
11.1.2 And subject to an unsatisfactory review, this contract will be terminated with immediate effect.


12. Non-Competition
12.1 During the period of this contract, you must not work for, provide services to, or otherwise be engaged by any other Halloween, scare attraction, scream park, immersive horror event, or similar venue or event deemed to be in competition with York Maze, Hallowscream or Hallowtween, without the prior written consent of the Company.
12.2 This restriction applies for the full duration of your contracted employment with the Company.

13. Photography & Videography
13.1 Due to the nature of the event/project for which you are engaged, photography and videography will be used during the course of the Event/Project for Marketing / Promotional purposes. This may mean you are included in such images and footage. By signing this agreement, you are giving your express permission to be included in any such photographs or video footage.

14. Social Media
14.1. You are prohibited from posting any photos/videos of backstage areas, photos in costume, photos of maze sets and/or any other photos or videos of this nature online in any capacity. You must not make any posts on personal profiles that are negative, bring the production or its employees into disrepute, or breach any confidentiality. This will be viewed as gross misconduct and could, depending on the circumstances (following a thorough investigatory process), result in the immediate termination of this agreement. Full policies and procedures will be issued during the onboarding process.

15. Intellectual Property Rights
15.1 Retained Rights. Each party will retain all right, title, and interest in and to its own Pre‐Existing Intellectual Property irrespective of any disclosure of such Pre‐Existing Intellectual Property to the other party, subject to any licenses granted herein.
15.2 Pre‐Existing Intellectual Property. Contractor will not use any Contractor or third-party Pre‐Existing Intellectual Property in connection with this Contract unless Contractor has the right to use it for the Company’s benefit. If the Contractor is not the owner of such Pre‐Existing Intellectual Property, they will obtain from the owner any rights as are necessary to enable Contractor to comply with this Contract.

16. Health & Safety
16.1 All Contractors have a duty to adhere to the Company’s policies from time to time in force, including but not limited to the Company’s Health and Safety and Fire Safety Policies. As a condition of engagement on this project, you will be required to attend Health & Safety Briefings. Without attendance to these, you will not be able to provide your services as a Performer for the Company.
16.2 There may be lights, sound and special FX including smoke and strobe lighting. If you have any health reason why these may affect you in any way, you will not be able to perform. Upon signing this contract, you are confirming you are not aware of any reason why you may not perform and that to the best of your knowledge, these special FX will not affect you in any way.

17. Termination
17.1 Either party may terminate the contract by giving 1 working days’ notice.
17.2 This contract will automatically terminate at the end of this Project.
17.3 Should the Contractor be convicted of a criminal offence, become insolvent, or behave in such a manner as to be viewed as gross misconduct; the Agreement herein will terminate with immediate effect.

18. Severability
18.1 The various provisions of this Agreement are severable, and if any provision or identifiable part thereof is held to be invalid or unenforceable by any court of competent jurisdiction then such invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions or identifiable parts.

19. Governing Law and Jurisdiction
19.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Contractor
I hereby warrant and confirm that I am not prevented by previous contractual arrangements, or in any other way, from engaging with the Company or performing any of the services referred to above. I accept the terms of this Agreement.
